Terms of service

These terms are the agreement between you and Kennebec Handsewn LLC when you use kennebechandsewn.shop or buy something from us. Please read them; by placing an order you accept them.
1. Who you are dealing with

2. Orders
An order is an offer to buy. The contract forms when we send an order confirmation. Until then we may decline an order — for example if a leather has run out, a price or description was wrong, the order looks fraudulent, or we cannot ship to your address. If we decline after taking payment, we refund in full.
3. Made to order and lead times
Most pairs are cut and sewn after you buy. Stated lead times (usually two to three weeks) are good-faith estimates and are not guarantees. We will tell you if your pair is running late; a delay of more than 30 days past the estimate entitles you to cancel for a full refund.
4. Prices and taxes
Prices are in United States dollars and exclude sales tax, which is calculated at checkout where we are required to collect it. We may change prices at any time, but not for an order already confirmed. International duties, import taxes and brokerage fees are yours to pay on delivery.
5. Payment
We accept major credit and debit cards through our payment processor. By submitting payment details you confirm you are authorised to use the payment method. Your card is charged when the order is placed. If a payment is reversed or charged back without cause, we may suspend further orders until it is settled.
6. Delivery and risk
Title and risk of loss pass to you when the carrier delivers the parcel to the address you gave us. Check the address; we cannot recover a parcel delivered to an address you typed incorrectly, though we will always try.
7. Returns, exchanges and repairs
Our shipping and returns policy forms part of these terms. In short: 30 days, unworn, refunded to the original payment method; sale and seconds pairs are store credit; the making is warranted for one year and normal wear is not a defect.
8. Leather is not uniform
Hides vary. Grain, colour, scarring and the shade of a dye lot differ between pairs and between the photograph and the shoe in your hand. That variation is a property of the material, not a fault, and it is not grounds for a warranty claim — though it is of course grounds for a return within the 30 days.
9. Fit advice
Sizing guidance we give you, in writing or over the telephone, is our best judgement and not a promise of fit. If a recommended size does not fit, the ordinary return and exchange terms apply.
10. Using this site
You may browse, buy and print pages for your own use. You may not scrape the catalogue, resell access, interfere with the site's operation, probe it for vulnerabilities, or use it to break the law. We may suspend access to anyone doing any of that.
11. Our content
The text, photographs, patterns, logos and design of this site belong to Kennebec Handsewn LLC and are protected by copyright and trade mark law. Do not reproduce them commercially without our written permission. Product names of third-party materials belong to their owners and are used descriptively.
12. What you submit
If you send us a photograph, review or suggestion, you give us a non-exclusive, royalty-free licence to use it in connection with the business, and you confirm it is yours to give. We may decline or remove anything.
13. Accuracy
We try to describe and photograph everything accurately, but we do not warrant that the site is free of errors. Where a listing is obviously wrong — a decimal point in the wrong place — we may cancel the order and refund you rather than honour the mistake.
14. Disclaimers
Except for the warranties we give in section 7 and any rights you have under law that cannot be excluded, the goods and this site are provided “as is” and we disclaim implied warranties of merchantability and fitness for a particular purpose.
15. Limitation of liability
To the extent the law allows, our total liability arising out of an order is limited to the amount you paid for it. We are not liable for indirect or consequential loss — lost profits, lost opportunity, or the cost of a substitute pair. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.
16. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including tannery supply failure, carrier disruption, severe weather, fire, labour action, and acts of government.
17. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The state and federal courts sitting in Dallas County, Texas have exclusive jurisdiction, and we each consent to venue there. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your place of residence.
18. Miscellaneous
If a provision of these terms is unenforceable, the rest stands. Our not enforcing a term on one occasion does not waive it. You may not assign this agreement; we may assign it as part of a sale of the business. These terms, the privacy policy and the shipping and returns policy are the entire agreement between us about their subject matter.
19. Changes
We may amend these terms. The version in force for your order is the one published when you placed it, and we keep the effective date at the top of this page current.
